01. Dependency

Juvenile Dependency 

From our perspective, juvenile dependency cases present a unique set of challenges and responsibilities. We are appointed to represent parents, legal guardians, or children who cannot afford to hire their own attorney in these proceedings. Here's how we view the process:

  1. Initial Contact: We often first become involved in a case when a parent or guardian is served with a dependency petition. This is often at what is called a "Shelter Hearing." We meet with our client to gather information and begin building a defense. Sometimes, the attorney you have at a Shelter Hearing is not the one who will be appointed to represent you in your ongoing case.                                                                                                                                                                                                               

  2. Client Advocacy: We advocate for our clients' rights throughout the process. We ensure that our clients understand the proceedings and help them make informed decisions about their case. This includes discussing what is happening on the legal side of the case versus what is happening on the placement side of the case.                                                                                                   

  3. Investigation and Preparation: We conduct our own investigation into the allegations of abuse or neglect. We may gather evidence, interview witnesses, and prepare our case for court.                                                                                                                  

  4. Court Hearings: We represent our clients at all court hearings. Normal rules of evidence may not apply at some hearings. In Dependency cases, there is an adjudication hearing where the court determines if the child will become a ward of the State. This is called a "Jurisdiction Trial." We present evidence, cross-examine witnesses, and argue on behalf of our clients.                                                                                             

  5. Case Planning and Review Hearings: We work with our clients to develop a case plan that meets the court's requirements. We attend review hearings to update the court on our clients' progress and address any concerns.                                                              

  6. Permanency Planning: We advocate for our clients' rights in permanency planning hearings. We may argue against termination of parental rights if we believe reunification is possible and in the best interests of the child, or if we represent the parent and that is the parent-client's position.                                                                                                                                                                                                                                                                                          

  7. Support Services: We often connect our clients with support services, such as parenting classes or substance abuse treatment, to help them address the issues that led to the dependency.                                                                                                  

In juvenile dependency cases, we work to ensure that our clients' rights are protected and that they have a fair opportunity to reunite with their children, if possible. We play a crucial role in advocating for parents and guardians who may be facing significant challenges.
